ESNNA CODE OF CONDUCT

UNO TRAVELER PERU strongly rejects sexual exploitation and trafficking, for this reason we are deeply committed to the protection of children, adolescents and vulnerable populations, and we are also against the Sexual Exploitation of Children and Adolescents (ESNNA). Our commitment includes strict implementation against any participation in these atrocious practices.

 

As part of this commitment, we work closely with local authorities, NGOs and communities to raise awareness and foster safe environments for all. We believe that tourism should be a force for good and we ensure that our tours and operations uphold the highest ethical standards, safeguarding those most at risk.

The Ministry of Foreign Trade and Tourism of Peru has established its commitment to combat the sexual exploitation of children and adolescents through the Code of Conduct against SEC. This important initiative of the Ministry of Foreign Trade and Tourism (MINCETUR) consists of raising awareness and training all actors in the tourism sector of our country with the aim of preventing and eradicating the sexual exploitation of minors under 18 years of age.

Considering: That the exploitation of human beings in any of its forms, especially sexual, and in particular when it affects children, violates the fundamental objectives of tourism and constitutes a denial of its essence as an activity that contributes to the development of our country, to the generation of a better quality of life, the dignity of the person and the protection of natural and cultural resources, being of vital importance to prevent situations that affect its sustainability and therefore, the human and economic development of the country;

Protected by international instruments such as the Convention on the Rights of the Child, ratified by Peru in 1990; the American Convention on Human Rights, ratified by Peru in 1978, which establishes in its article 19 that “Every child has the right to the protection measures that, as a minor, he or she requires from his or her family, society and the State”; Convention 182 on the Prohibition of the Worst Forms of Child Labor of the International Labor Organization, ratified by Peru in 2001; the Stockholm Declaration against the Commercial Sexual Exploitation of Children of 1996; the Global Code of Ethics for Tourism of the World Tourism Organization (UNWTO) and the Yokohama Declaration, both of 2001; and the “Protocol to prevent, suppress and punish trafficking in persons, especially women and children, supplementing the United Nations Convention against Transnational Organized Crime” – Palermo Protocol, 2000.

In compliance with the legal provisions that support the obligation of the Peruvian State and all its citizens to guarantee the protection and fulfillment of the rights of minors living in its territory, such as the Political Constitution of Peru, the Code of Children and Adolescents, Law No. 28950 Against Human Trafficking and Smuggling of Migrants, Law 28251 that modifies the Penal Code on issues related to sexual exploitation of girls, boys and adolescents and other related regulations; as well as Supreme Decree No. 007-2007-MINCETUR; With the full endorsement of our manager and workers, we formally declare that:

1.- We reject the Sexual Exploitation of Girls, Boys and Adolescents ESNNA in Peru and in the world, in general and in particular in its form associated with travel and tourism, because it is a conduct that violates the fundamental rights of people, contrary to the intrinsic objectives of tourism activity in our country.

2.- We denounce and condemn those who take advantage of tourism activities and the facilities and services they offer to promote, facilitate or tolerate the occurrence of sexual exploitation of girls, boys and adolescents; and in virtue of the above.

We resolve:

Subscribe to this Code of Conduct against the Sexual Exploitation of Girls, Boys and Adolescents in the field of Tourism, which will be governed by the following articles:

Article 1.- Purpose

This Code is a formal declaration of free adhesion that aims to establish and enforce the standards of conduct for all people who work at the company UNO TRAVELER PERU . Aimed at the care and protection of girls, boys and adolescents from all forms of sexual exploitation and human trafficking associated with travel and tourism.

Article 2.- Definitions

For all purposes of this Code we adopt the following definitions:

Boy, Girl or Adolescent – in accordance with Article I of the Preliminary Title of the Code of Children and Adolescents, a boy or girl is considered to be any human being from conception until reaching twelve years of age and an adolescent from twelve to eighteen years of age.

Human trafficking.- This is a crime that promotes, favours, finances or facilitates the recruitment, transportation, transfer, reception or retention of another person, anywhere in the country, using for this purpose: violence, threats or other forms of coercion, deprivation of liberty, fraud, deception, abuse of power or taking advantage of a situation of vulnerability (poverty, minor, illness), or the granting or receiving of payments or benefits, for the purposes of exploitation, so that the person may engage in prostitution, subject him or her to sexual slavery or other forms of sexual exploitation.

Sexual Exploitation of Girls, Boys and Adolescents in the Field of Tourism. – Given by a person or persons, who move from their place of origin or native country, with the objective of establishing sexual contact with girls, boys and adolescents, occasionally or permanently.

Article 3.- Obligations

By virtue of this Code, the people who make up this Company, in order to take the necessary measures to protect girls, boys and adolescents against sexual exploitation, we commit to:

  1. Maintain an ethical policy of rejecting the commercial sexual exploitation of girls, boys and adolescents in the context of travel and tourism.
  2. Inform and train staff on the company’s policy regarding the prevention of sexual exploitation of girls, boys and adolescents in tourism and travel.
  3. Maintain visible symbols that alert customers and suppliers about the position regarding the sexual exploitation of girls, boys and adolescents in tourism and travel.
  4. Include a clause in contracts with tourism service providers stating the common rejection of the sexual exploitation of girls, boys and adolescents. The following paragraph will be used: “Tourism promotes childhood and adolescence free from sexual exploitation, therefore, we do not accept any act that favors the sexual exploitation of girls, boys and adolescents.”
  5. Submit an annual report detailing the actions taken by the Company to protect children and adolescents from sexual exploitation. This report must be supported by photographs, training lists, website links, and other elements that prove that the company is exercising sustained corporate social responsibility in the area of ESNNA prevention .
  6. This information must be sent to the MINCETUR offices, via email email esnna@mincetur.gob.pe, or to Calle Uno Oeste 050 Urb. Córpac San Isidro, Lima.

 

MINCETUR may verify compliance with these measures through its sectoral regulations created for this purpose, for which monitoring will be carried out through MINCETUR. After signing the Code of Conduct, the undersigned Company may use the “Protégeme” logo in the advertising materials that the company uses, such as merchandising, website, among others.

Actions developed by UNO TRAVELER PERU against ESNNA

By adhering to the Code of Conduct to eradicate the Sexual Exploitation of Girls, Boys and Adolescents (ESNNA) we commit to constantly implement a series of actions, including:

 

In the specific case of travel agencies and tour operators, such as UNO TRAVELER PERU , we adhere to this commitment by signing the Code of Conduct regarding ESNNA, before GERCETUR and we undertake to comply with the principles and duties established in this document; as well as in compliance with the General Law of Tourism and its regulations regarding the prevention of ESNNA.
Promote awareness and training of all members of our team: administrative staff, operational staff, commercial staff and other parties; in order to contribute to the eradication of ESNNA.

 

Likewise, promote awareness and training of all our interest groups, including: guides, cooks, drivers, support staff (porters), muleteers, community rural tourism companies, hotels, hostels, restaurants (as well as their respective collaborators) and other interest groups; with the aim of contributing to the eradication of ESNNA. In this sense, in accordance with our values and legal aspects, none of the interest groups offers or accepts requests related to the different modalities of commercial sex associated with:

 

  • The use of children and adolescents in pornographic activities.
  • Sex tourism.
  • Trafficking of girls, boys and adolescents for purposes of commercial sexual exploitation.

 

In short, through the practice of responsible tourism in tourism in general, UNO TRAVELER PERU promotes the development and well-being of local populations and all their stakeholders. In this sense, our commitment to the ESNNA program also leads us to develop actions to prevent and eradicate sexual exploitation against minors.
